Gozio Inc. (referred to as "Gozio," "we," "our," "us," or "Company") recognizes the importance of protecting the personal information we may collect from visitors and any other individual or entity ("Users," "you," or "your"). Gozio has created this App Privacy Policy ("Privacy Policy") to inform you of our information collection, use, and sharing practices.
The practices described in this Privacy Policy apply only to information gathered through mobile applications created by us for our customers (the “App”) and do not necessarily reflect our practices with respect to information gathered through other means. This mobile app is called My Nicklaus Children's. Use of the App is subject to our Application End User License Agreement (“EULA”) and to our personal information gathering and dissemination practices and policies as described below.
Our Privacy Policy explains: (1) what information we collect; (2) why we collect it; (3) how we use that information; (4) how we may share it; (5) the choices we offer, including how to access and update information; (6) and the measures we take to keep your information safe.
Please familiarize yourself with our privacy practices. By using the App, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, please do not use the App.

Our Privacy Policy applies to your use of the App and any services offered by Gozio or its customers through the App, but excludes services that have separate privacy policies that do not incorporate this Privacy Policy.
Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you or other sites linked from the App or services. For example, if you access a hospital’s patient portal or appointment reservation system through the use of the App, the privacy policy of the hospital will govern the use of your personal information and not our Privacy Policy. Our Privacy Policy does not cover the information practices of other companies and organizations who advertise our services, and who may use cookies, pixel tags and other technologies to serve and offer relevant ads.
Account Creation We do not require that you create an account in order to utilize the App, and therefore do not collect personal information through its usage such as name, email or similar identifying attributes. However, while we do not have your personal information, the App does use Unique Identifiers (as discussed below).
Unique Identifiers We use “Unique Identifiers” to enable your use of the App. Unique Identifiers are small files that are stored on your device when the App is first installed, for the purposes of identifying your device. Unique Identifiers are installation specific: if the App is uninstalled and reinstalled, the old Unique Identifier is deleted and a new Unique Identifier is installed. These Unique Identifiers do not contain any personally identifiable information or information that we could use to ascertain your identity, such as your name. We use Unique Identifiers for consistent usage across sessions in the App, to track the usage of the App, and to enhance your use of the App.
App Usage We may collect information regarding App usage such as geographic, specific feature usage, and search information. We utilize this information to analyze the performance of and improve the App to provide current and future users with a fulfilling experience.
If you grant us access to your location, Gozio may collect information about the location of your device when you use our App. Your device’s location can be determined by information about things near your device (such as Bluetooth transmitters), GPS, Wi-Fi access points, and cell towers. When you use the services provided through our App via your device, we may solicit your permission to collect your location data. Some features within our application may only function upon confirmation of your device’s location, and therefore such features will not be available if you choose not to provide the location data to us. The specificity of the location data collected may depend on a number of factors, including the type of wireless technology used to locate your device (e.g., via Bluetooth or Wi-Fi), the device you are using (e.g. smartphone or tablet), and how your device is connected to the Internet (e.g., via Wi-Fi). If you enable location services for our App, we may collect location data periodically as you use or leave open our App. Depending on the device platform (e.g., Apple’s iOS or Google’s Android), you may be able to control whether location data is collected from within “Settings” or other controls on your device or the App.
Should you choose to utilize the calendar functionality of the App, all event specific data regarding such functionality (date, time, location, notes, etc.) will be stored locally on the device and we will not have access to such data.
Your mobile device may notify our application when you get near certain navigation destinations. In some cases, this may require you to enable background location settings within your device. This feature enables our application to provide an arrival notification, provide on-site wayfinding and other interaction relating to your arrival.
Usage Tracking We may monitor how Users use our App including, without limitation, search terms entered, pages visited, and documents viewed. This information may be stored by us along with your Unique Identifier. Aggregated forms of this data may also be used in order to help us understand areas for future research, identify future features and functions to develop for the App, and to market the App.

Aggregated Information We may collect aggregated information about our users and devices, such as geographic, App feature usage, and search information. We may share certain information that we collect with our customers and other business partners regarding the uses of the App. The aggregated information that we provide is not linked to any personally identifiable information.
Services We will use your information to provide information or perform services that you request we, or a third party, provide or perform, such as searching for applicable medical providers or using your location to find a nearby point of interest. If the applicable information is to be provided or service is to be performed by a third party, then we will disclose only the applicable information to the third party providing the information or performing the applicable service, ensuring your information is shared in a secure manner utilizing industry-standard methods.
Internal Use We may use your information internally within our business for the purposes of furthering and improving our services to users and the App.

We provide services to a variety of healthcare organizations and when we do, you are subject to their privacy policies. The App may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy notice of every website you visit.
We keep your personal information only for as long as we need to. This period may depend on what we are using your information for, in accordance with this Privacy Policy. If your personal information is no longer required, we will delete it or make it anonymous by removing all details that identify you. However, if necessary, we may retain your personal information for our compliance with a legal, accounting, or reporting obligation or for archiving purposes in the public interest, scientific, or historical research purposes or statistical purposes.
If you provide us with personal information you understand that we will collect, hold, use and disclose it in accordance with this Privacy Policy. You retain the right to request details of any personal information we hold about you.
If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.
If you have previously agreed to our using your personal information for marketing purposes, you may change your mind at any time. We will provide you with the ability to unsubscribe from our email-database or opt out of communications. We may need to request specific information from you to help us confirm your identity.
If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, please contact us at privacy@goziohealth.com. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading, or out of date.
If you believe that we have violated a relevant data protection law and wish to make a complaint, please contact us at privacy@goziohealth.com and provide us with full details of the alleged violation. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint. You also have the right to contact a regulatory body or data protection authority in relation to your complaint.
Gozio takes commercially and technologically reasonable precautions to protect data and information under its control from misuse, loss, or alteration. Gozio’s security measures include industry-standard technology and equipment to help protect your information, and we maintain security measures to allow only the appropriate personnel and contractors access to your information. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, taking into account technological reality, cost, the scope, context and purposes of processing weighted against the severity and likelihood that the processing could threaten individual rights and freedoms. For example, we use commercially reasonable security measures such as encryption, firewalls, and transport layer security (TLS) or hypertext transfer protocol secure (HTTPS) to protect Personal Data.

By providing an email address on the App, you agree that we may contact you in the event of a change in this Privacy Policy, to provide you with any service related notices, or to provide you with information about our events, invitations, or related educational information.
For purposes of this Privacy Policy, “opt-in” is generally defined as any affirmative action by a User to submit or receive information. For example, you may check a box when presented with an option to opt-in to our marketing communications.

Notwithstanding anything else in this Privacy Policy, please note that we always reserve the right to contact you in the event of a change in this Privacy Policy, or to provide you with any service related notices.
Gozio does not track its Users across third party websites or over time to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, your browser may include controls to block and delete cookies, web beacons and similar technologies, to allow you to opt out of data collection through those technologies.
California residents are entitled to contact us to request information about whether we have disclosed Personal Information to third parties for the third parties’ direct marketing purposes. Under the California “Shine the Light” law, California residents may opt-out of our disclosure of Personal Information to third parties for their direct marketing purposes. You may choose to opt-out of the sharing of your Personal Information with third parties for marketing purposes. To make such a request you should send (a) an email to privacy@goziohealth.com with the subject heading “California Privacy Rights,” or (b) a letter addressed to Gozio Inc., 1372 Peachtree St NE Atlanta, GA 30309. In your request, please attest to the fact that you are a California resident and provide a current California address for our response. Not all information sharing is covered by the California privacy rights requirements and only information on covered sharing will be included in our response. We reserve our right not to respond to requests submitted to addresses other than the addresses specified in this paragraph.
The App is not intended for use by children. We do not intentionally gather personal information about visitors who are under the age of 13. If a child has provided us with personal information, a parent or guardian of that child may contact us to have the information deleted from our records. If you believe that we might have any information from a child under age 13, please contact us at privacy@goziohealth.com. If we learn that we have inadvertently collected the personal information of a child under 13, or equivalent minimum age depending on jurisdiction, we will take steps to delete the information as soon as possible.
We reserve the right to change or modify our information collection, use and disclosure practices set forth in this Privacy Policy. If we decide to change our Privacy Policy, we will post those changes to the App so our users and customers are always aware of what information we collect, use and disclose. If you object to the change to our Privacy Policy, then you must contact us using the information provided in the notice. We will otherwise use and disclose a user’s information in accordance with the Privacy Policy that was in effect when such information was collected.
If Gozio experiences a “change in control” (defined below), then we may amend our information practices as described in this Privacy Policy. We will disclose your information to the legal entity that succeeds our operation of the App. The privacy policy of the succeeding legal entity will then govern the information that we have collected from you under this Privacy Policy. However, if applicable law prohibits the succeeding legal entity’s privacy policy from governing, then this Privacy Policy will continue to govern.
